2004

NEW: The Western Washington Growth Management Hearings Board issued a Compliance Order on June 23, 2004 finding that the County is in compliance with the State Environmental Policy Act (SEPA), but not with the Growth Management Act (GMA), specifically with regard to the Dosewallips Small-scale Business & Cottage Industry (SBCI) overlay district.

The Order gave the County 90 days to come into GMA compliance.  The Board of County Commissioners (BOCC) held a public hearing and adopted an ordinance on Monday, October 4, 2004.  Ordinance No. 11-1004-04 effectively removes the SBCI overlay district.

Previously, the BOCC held a public hearing on Monday, March 1, 2004 in consideration of a proposal to address a growth management Order concerning the 2002 adoption of the Brinnon Subarea Plan.  At the conclusion of the hearing, the BOCC adopted Ordinance No. 01-0301-04, which establishes a Brinnon Subarea Plan Epilogue.  The following documents contain information relevant to the County growth management compliance effort for the Brinnon Subarea Plan:

Through Ordinance 13-1213-02 signed on December 13, 2002, the Board of County Commissioners (BOCC) adopted the May 1, 2002 version of the Brinnon Subarea Plan as a part of the Jefferson County Comprehensive Plan, along with associated amendments to the Comprehensive Plan.  Through Ordinance 18-1213-02 also signed on December 13, 2002, the BOCC adopted the May 1-proposed Unified Development Code (UDC) amendments intended to implement the Brinnon Subarea Plan.

For Portable Document Format copies of the adopting ordinances and other information, visit the 2002 Comprehensive Plan Amendment Docket web page.  For reference, the proposed Brinnon Subarea Plan and associated Comprehensive Plan and UDC amendments were packaged as application number MLA02-246.  The May 1, 2002 version of the Brinnon Subarea Plan is found under the "Plan Drafts" section below.

The effective date of the Brinnon Subarea Plan and associated implementing regulations is December 13, 2002.  Replacement pages for the Comprehensive Plan and UDC are posted on the Comprehensive Plan and UDC web pages, respectively.

Brinnon Subarea Planning Group Effort

In 1999, the Board of County Commissioners (BOCC) appointed a volunteer committee, the Brinnon Subarea Planning Group (BSPG), for the task of developing a recommended Brinnon Subarea Plan to, among other goals, fulfill LNP 4.8 from the 1998 Comprehensive Plan.  The BSPG met twice monthly from December 1999 through August 2001.  Minutes of BSPG meeting are kept on file at DCD.  Consult the inside cover page of the 1-16-02 draft Brinnon Subarea Plan for a list of original and final membership in the BSPG.

The BSPG held a community meeting on July 31, 2001 to describe the draft proposal to the Brinnon community and solicit feedback.

At their August 28, 2001 meeting, the BSPG finalized the group recommendation by consensus.  The August 28 draft was delivered to the BOCC, which then gave the BSPG recommendation to the Planning Commission for formal deliberation and recommendation.

On Saturday, April 20, 2002, the BSPG held a "Brinnon Subarea Plan Open House" at the Brinnon School Multipurpose Room.  Representatives from the BSPG, Jefferson County government, the Washington Department of Fish and Wildlife, and other interested parties made presentations, shared information, answered questions, and exchanged ideas.

Planning Commission Deliberation

Pre-2002 Comprehensive Plan amendment cycle: The Jefferson County Planning Commission held a public hearing concerning the August 28, 2001 proposed Brinnon Subarea Plan on October 17, 2001 at the Brinnon School.  After deliberation during several meetings in December 2001 and January 2002 and a public hearing on January 16 concerning the associated UDC amendments, the Planning Commission voted 5 to 2 at their January 16, 2002 meeting to recommend a version of the Brinnon Subarea Plan to the BOCC for consideration and action. The January 16, 2002 draft version is a line-in/line-out version of the August 28, 2001 draft Brinnon Subarea Plan recommended by the Brinnon Subarea Planning Group and forwarded to the Planning Commission by the BOCC.

The Planning Commission recommended draft indicates proposed substantive changes by the crossing out of original text and the underlining of new language. Changes related to grammatical consistency are not highlighted. Proposed changes to map titles and legends are listed on the appendix cover sheet in the Planning Commission recommended draft. The maps in the appendix of the Plan are not included in this draft, but can be accessed via the map links below.

The Planning Commission also voted 5 to 2 at their January 16 meeting to recommend amendments to the Unified Development Code to implement provisions of the recommended Brinnon Subarea Plan. These proposed amendments are available at DCD.

DCD formally transmitted the Planning Commission recommendation, including Findings of Fact and Minority Reports, to the Board of County Commissioners on Tuesday, February 19, 2002.  For a detailed historical summary of the Brinnon subarea planning process up until early 2002, consult the Planning Commission Findings of Fact linked below.

Changes to the Growth Management Act made by the State Legislature in early 2002 required that the Brinnon Subarea Plan and associated Comprehensive Plan and UDC amendments be part of the 2002 Comprehensive Plan annual amendment cycle. See subsection (2)(a)(i) of this bill signed by Governor Locke.  Because the proposed Brinnon Subarea Plan included changes to the Comprehensive Plan designations (i.e., Land Use Map), the BOCC-sponsored May 1, 2002 preferred alternative Brinnon Subarea Plan and associated Comprehensive Plan and UDC amendments were considered by the Planning Commission and the BOCC as part of the 2002 annual amendment cycle "docket."

Planning Commission review during the 2002 Comprehensive Plan amendment cycle: The Planning Commission considered the BOCC-sponsored May 1, 2002 preferred alternative Brinnon Subarea Plan and associated Comprehensive Plan and UDC amendments as part of the 2002 Comprehensive Plan amendment "docket" and subsequently made a recommendation to the BOCC together with recommendations concerning other proposed Comprehensive Plan amendments on the 2002 Docket.  The Planning Commission held a public hearing on the proposed Brinnon Subarea Plan package and other suggested Comprehensive Plan amendments on September 4, 2002, deliberated on the Brinnon Subarea Plan package on October 30, and voted unanimously (with one abstention) on November 13 to recommend adoption of the May 1, 2002 package in its entirety.  The Planning Commission recommendation was transmitted to the BOCC on November 22, 2002 and is included among the Appendices of the 2002 Comprehensive Plan Amendment Docket DCD Final Supplemental Environmental Impact Statement (FSEIS) dated November 25, 2002.

The BOCC held a public hearing on Tuesday, March 12, 2002 at the Brinnon School to hear testimony on the proposed Brinnon Subarea Plan (January 16, 2002 Planning Commission-recommended version) and associated UDC amendments. To see the legal notice published in the Leader newspaper, click here.

The BOCC deliberated on the Planning Commission recommendation during Regular Agenda meetings on March 25 and April 8, 2002.

At the April 8 meeting, the BOCC directed DCD to make specific changes to the proposal recommended by the Planning Commission. DCD prepared a BOCC-sponsored May 1, 2002 preferred alternative Brinnon Subarea Plan and associated Comprehensive Plan and UDC amendments for inclusion as a package on the 2002 amendment cycle docket. The May 1, 2002 Brinnon Subarea Plan is a clean version without any line-in/line-out strike-through or underlined text representing edits to earlier drafts. A packet of pages representing line-in/line-out changes to the January 16, 2002 draft as directed by the BOCC on April 8 is available at DCD.

BOCC review during the 2002 Comprehensive Plan amendment cycle: The BOCC decided to accept the Planning Commission recommendation and DCD staff recommendation to adopt the May 1 Brinnon Subarea Plan package as proposed.  On December 13, 2002, the BOCC signed the ordinances that formally adopted the Brinnon Subarea Plan and associated Comprehensive Plan and UDC amendments.

There are counter copies at the Department of Community Development (DCD) and the BOCC office available for review on-site and copies of drafts have been provided to the County Public Library.
